Scope and Acceptance of Terms

These general conditions of sale govern the contractual relations between Hématomes Editions and its client, both parties accepting them without reservation.

The customer acknowledges having read, at the time of placing the order, the specific conditions of sale stated on this screen and expressly declares to accept them without reservation.

These general terms and conditions of sale apply to all sales concluded on the website https://hematomes.be, subject to specific conditions indicated on the product presentation pages.

These conditions may be modified at any time without notice by the site administrator and prevail over any other condition appearing in any other document, except by prior, express and written exception.

Description of items

The website https://hematomes.be offers for sale intellectual works in physical form (in particular printed books) but also digital (ebooks, audiobooks, etc.). The digital books (or e-books) sold on https://hematomes.be are digital files containing intellectual works intended to be downloaded for reading on electronic terminals.

Both printed and digital works are protected by Belgian and international copyright laws. In the absence of a license specifying other conditions of use, downloaded files are reserved for the exclusive use of the purchaser. They may not be resold, rented, or transmitted free of charge beyond the purchaser’s family circle and legitimate private use; any representation or reproduction of these files, in whole or in part, outside the cases provided for by Article L122-5 of the Intellectual Property Code, is strictly prohibited and would expose their holder to prosecution.

In order to protect the rights of authors without restricting the use of downloaded files by those who have legitimately acquired them, certain titles purchased on this site are personalized with data from the customer (name, first name, email address), via a digital marking dynamically affixed to each page or inside the digital file.

Orders

All orders are placed exclusively on the website https://hematomes.be. Payment is made upon ordering. Customers must be at least 18 years old or have parental consent to place an order on https://hematomes.be.

Clicking on the “Pay” button on the screen summarizing the order and the explicit acceptance of these general conditions of sale constitutes an electronic signature which expressly certifies the customer’s unreserved consent to these general conditions of sale and to the specific conditions (in particular the unit price) specific to each book or file purchased. The customer therefore waives the right to rely on any contradictory document and, in particular, their own general conditions of purchase. The customer may abandon their order until payment has been validated. The information provided by the buyer when placing the order is binding on them: in the event of an error in the wording of the recipient’s contact details, the seller cannot be held responsible for any inability to deliver the product.

For security reasons, each order basket is limited to a maximum amount of €300.00 including VAT, and the number of orders per customer is limited to 7 per 7 days. These limits can be modified upon request from the user.

Any order with a fraud risk profile may be blocked by the administrator at the payment stage.

Automatic registration systems are considered proof of the nature, content, and date of the order. Hématomes Editions confirms acceptance of the order to the customer at the email address provided. The sale will only be concluded upon confirmation of the order. Hématomes Editions reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order.

All orders placed on the website https://hematomes.be are intended for the personal use of customers. Customers or recipients of the products are prohibited from any resale, partial or total, of the products.

Availability of items

The articles are normally accessible to the customer 24 hours a day, 7 days a week, all year round. However, the administrator of this site reserves the right to temporarily close access without notice.

It cannot be held responsible for technical problems beyond its control, such as connection problems due to Internet service providers or computer problems due to the customer’s hardware or software.

Price

Product prices are deemed net in euros, inclusive of all taxes and excluding shipping costs for printed works. All orders are invoiced in euros and payable in euros. The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for Belgium and EEC countries. This price includes the price of the products, handling costs, transport costs and commissioning.

Due to the impossibility of verifying the customer’s address for orders including digital works, Belgian VAT of 6% is applied to all works, whether printed or digital.

Printed books are sold in compliance with applicable provisions, particularly the Lang law on the fixed price of books, which is set by the publisher. The price indicated on the product sheets does not include shipping.

For any delivery outside Belgium, any customs fees or local taxes remain the responsibility of the recipient.

Shipping costs

Shipping costs are calculated based on the number of items ordered and their weight. The amount varies only depending on the geographic area and shipping method chosen by the customer. The customer can choose their shipping method: pick-up from the publisher, in Liège, or via Mondial Relay delivery.

If the order only contains ebooks, no shipping costs are applied.

Payment

The price is payable in full and in a single payment upon ordering. Payment for purchases is made exclusively by bank card and via our partner Mollie.

Once payment has been validated by Mollie and the buyer’s bank, the order is confirmed and is being prepared. The buyer can cancel their order and receive a refund by contacting customer service as soon as possible by email (https://hematomes.be). If the buyer’s bank refuses, the order will be automatically canceled and the customer will be notified by email.

Delivery

Regardless of the destination country, printed works are always delivered to the address indicated when ordering or to a Mondial Relay collection point. The delivery time includes the time taken to prepare the package (minimum 48 working hours) plus the time taken by the carrier.

For deliveries outside Belgium, the customer agrees to pay all taxes due on the importation of products, customs duties, value added tax, and all other taxes due under the laws of the country where the order is received.

Any delays do not entitle the buyer to claim damages.

Delivery guarantee

The following are considered force majeure events that relieve the seller of their obligation to deliver: war, riots, fire, strikes, accidents, and the impossibility of obtaining supplies. Goods always travel at the recipient’s risk.
For availability reasons, an order may be delivered to the customer in multiple installments. The customer then pays for only one delivery. If the customer requests two delivery locations, they place two orders, with the associated delivery costs.

Warranty, Return and Refund

Defective Items
New items sold on this site are guaranteed against defects. However, if any of them are defective or non-compliant, the buyer has the right to return them and has 48 hours to notify Hématomes Editions of any reservations in the event of missing or damaged items and 14 days from the date of reception to return the product, new and undamaged, in its original packaging, or by email if it is a digital format. Upon reception of the defective item, a new product will be sent to you if it is a printed item or if it is offered for download for digital format items. Any return shipping costs will be reimbursed to the customer.

Return request

Any buyer may withdraw and return the item(s) ordered within 7 days from the date of receipt of their package. To facilitate the processing of your request, we thank you for contacting customer service by email (info@hematomes.be). Hématomes Editions is required to reimburse the amount of the returned items, excluding shipping costs. The amount of return shipping costs remains the responsibility of the buyer. The refund is due within a maximum of 15 days.

Protection of your personal data – GDPR

Some of the information requested from our customers is necessary for the proper processing of orders, and other information is useful for getting to know our customers better and thus improving the services offered on this site.

Customer files and the processing to which they are subject are carried out in compliance with the law relating to information technology, files and freedoms of January 6, 1978 as well as the (European) General Data Protection Regulation (GDPR) n° 2016/679 of April 27, 2016 and implemented on May 25, 2018.

Thus, if you are registered on the site, you have the possibility of exercising the following rights at any time:

Right of access to personal data.
Right to rectification of personal data.
Right to erasure (right to be forgotten) of personal data.
Right to restriction of processing of personal data.
Right to portability of personal data.
Right to object & profiling of your personal data.

Visitors to the site are also informed that “cookies” record certain information that is stored in the memory of their hard drive. This information is used to generate site audience statistics and to offer products and services based on previous visits. An alert message may ask the visitor, beforehand, if they wish to accept “cookies”, which they can of course refuse. It is also possible to configure their browser to accept or refuse “cookies” from the site at any time. These “cookies” do not contain confidential information about the visitor.

Our commitments regarding your personal data and their processing:

Our employees and subcontractors are informed and committed to a confidentiality approach with regard to your personal data.
Your data is hosted on secure servers that comply with the GDPR.
We, as well as our subcontractors, have a Data Protection Officer (DPO) registered with the CNIL (French Data Protection Authority).
We maintain a register of data processing relating to our users.
For each data processing, we verify that we collect only the data necessary for the processing.
If a data processing operation is considered risky, we are able to carry out an impact assessment on this processing to further secure the data.
When we design a new feature, software, or make a service available to our users, the protection of your personal data is integrated from the design stage.
If a breach of your personal data is detected, we will inform you and the CNIL.
We maintain up-to-date documentation regarding our approach to personal data protection and compliance with the GDPR.
We take all necessary measures to provide you with the maximum level of security for your data.
Finally, we allow you to exercise your rights, in accordance with the GDPR (via the form located on our “Protection of your personal data - GDPR” page).

Responsibility

The website https://hematomes.be disclaims all liability in the event of non-performance of the contract due to force majeure (strike, flood, fire, etc.).
The site https://hematomes.be cannot be held responsible for the content of the sites on which its products are referenced.
The products offered comply with current Belgian legislation. The website https://hematomes.be cannot be held liable for non-compliance with the legislation of the country where the product is shipped or downloaded. It is the buyer’s responsibility to check with the relevant local authorities regarding the possible uses of the products ordered.

In all cases, Hématomes cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country. Hématomes’ liability is systematically limited to the value of the product in question, the value on its date of sale, without any possibility of recourse against the brand or the company producing the product.

Disputes and applicable law

This contract is subject to Belgian law.
Hématomes’ liability will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have occurred despite all precautions taken in the presentation of the products.

In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other advisor of his choice. It is recalled that the search for an amicable solution does not interrupt the “short period” of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the assessment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive kindness, good faith always being presumed in those who take the trouble to explain their situations.

In the event of a dispute, the customer will first contact the company to seek an amicable solution. Failing this, the Commercial Court of Liège shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
